‘survive’ game TERMS OF SERVICE and end user LICENSE agreement (EULA)

Survive game is downloadable via Google Play app store.

The following Terms of Service and End User License Agreement (“EULA”) constitute a binding agreement between you and Sandbay Games Oy (“Creator”), a Finnish game company. This EULA governs your use of the downloadable “Survive” game app and any related services (“Software”). 

BY INSTALLING, USING OR OTHERWISE ACCESSING THE SOFTWARE, YOU AGREE TO THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS OF SERVICE, PLEASE DO NOT INSTALL, USE OR OTHERWISE ACCESS THE SOFTWARE.

Disclaimer of Warranties and Liability
UNDER APPLICABLE LAW, 'Survive' GAME IS PROVIDED TO YOU “AS IS,” WITH ALL FAULTS, WITHOUT WARRANTY OF ANY KIND, WITHOUT PERFORMANCE ASSURANCES OR GUARANTEES OF ANY KIND, AND YOUR USE IS AT YOUR OWN RISK.

In no event will the Creator be liable for any direct, indirect, special, incidental, or consequential damages arising from the possession, access, use, or malfunction of the Software. This includes, but is not limited to, damages to property, loss of goodwill, computer failure, or, to the extent permitted by law, personal injuries, lost profits, or punitive damages, arising out of or related to this EULA or the Software.

Changes to the EULA

The Creator reserves the right to change, modify, add, or remove portions of these Terms of Service, this EULA, its privacy policy and other relevant policies at its discretion by posting updates on the game’s website. By continuing to use the game after changes are posted, you accept the updated terms. If at any point you do not agree to any portion of the then-current version of our Terms of Service, the Privacy Policy any other policy, rules or codes of conduct relating to your use of the Software, your right to use the Software shall immediately terminate, and you must immediately stop using the Software.

This EULA is governed by the laws of Finland, without reference to its conflict of law principles.
